Overview
A patent gives the exclusive right to make, use and sell an invention for the statutory term, in exchange for publishing how it works. It requires novelty, an inventive step and industrial applicability under the Patents Act, 1970.
India is first-to-file, so the filing date is the asset — a provisional application secures priority while the invention is developed further. Patents are also frequently the thing an investor is really valuing in a technology business, and they can be licensed or assigned independently of the company.
The claims decide everything. They define the scope of protection, and drafting that is too narrow leaves competitors a lawful path around the patent permanently.
